U.S. District Judge Lucy Koh in San Jose, California, had previously denied Apple's bid for an injunction on the tablet and multiple Galaxy smartphones. However, a federal appeals court instructed Koh to reconsider Apple's request on the tablet.

"Although Samsung has a right to compete, it does not have a right to compete unfairly, by flooding the market with infringing products," Koh wrote on Tuesday, adding the order should become effective once Apple posts a $2.6 million bond to protect against damages suffered by Samsung if the injunction is later found to have been wrong.

Apple has waged an international patent war since 2010 as it seeks to limit the growth of Google's Android system, the world's best-selling mobile operating platform. A decisive injunction in one of the U.S. legal cases could strengthen Apple's hand in negotiating cross-licensing deals, where firms agree to let each other use their patented technologies.

Opponents of Apple say the iPhone and iPad maker is using patents too aggressively in its bid to stamp out competition.

"The relief being given to Apple here is extraordinary. Preliminary injunctions are rarely asked for and rarely granted," said Colleen Chien, a professor at Santa Clara Law in Silicon Valley.

Apple must now place a bond in excess of £60 million ($100 million) – to compensate Samsung for lost sales if the verdict is not upheld in court – to enforce the rare pre-trial injunctions.

Although the ban could end up being only temporary, it still represents a major blow for the Korean tech giant and its partner Google - the patents being contested largely relate to the Internet behemoth's Android operating system.

Judge Koh highlighted four specific patents held by Apple as "likely" having been infringed by the Samsung device and the OS it runs, including one related to the Siri voice-activated assistance feature available on the iPhone 4S.

The case has likely put a damper on an otherwise encourage week for Google, with the Mountain View-based company hogging a considerable amount of the limelight over the last few days on the back of its I/O conference and, more specifically, the Project Glass augmented reality device that was launched there.

In a worst case scenario, Judge Koh's ruling could necessitate a complete redesign of Google's latest Android OS – including the much sought after Ice Cream Sandwich, and the most recent incremental upgrade, Jelly Bean 4.1, which was also unveiled at I/O this week.

Given Apple's aggressive attitude in seeking legal blockades against its rivals, it is not implausible to foresee the Cupertino-based company bringing similar cases against other manufacturers of Android-powered phones.

The ruling contrasts with a recent decision made in Apple's case against Motorola, where a judge ruled that neither side could prove lost earnings, and terminated the proceedings.

This preliminary injunction feels more like a violation of antitrust law to me.

The 'irreparable harm' Apple may experience could be so overwhelming that an injunction is needed, but if it goes the other way, Samsung's market and monetary losses are suddenly quantifiable at $100m?

Seems like it would make more sense to allow Samsung to compete and if found in violation of any patents, ordered to pay licensing fees. :?

Barring the appeal, if it drags out for so much as a year, Apple could also have the advantage of bringing their next gen product to market before this gen of Samsung product(s) even enters the US market.

Don't get me wrong, I love my iPhone, but like Neversoft points out, these tech design/software patent wars are bordering on the absurd. :shock:

The district court is not the last chance for Samsung to get the injunction lifted.

Samsung has also appealed to a federal appeals court in Washington, DC, which has exclusive jurisdiction over intellectual property disputes.

An Apple spokeswoman reiterated the company's previous comment that Samsung's latest products look a lot like the iPhone and iPad.

‘This kind of blatant copying is wrong and, as we've said many times before, we need to protect Apple's intellectual property when companies steal our ideas,’ the spokeswoman said.

I dismissed the entire article once the writer used the term "Fandroid" with a straight face. Otherwise, I'd agree that companies should innovate not imitate, but there's only so far you can go with a lump of shiny plastic and glass that you poke at with your fingers and many of these patents seem overly broad or have prior art.

In theory then the appeals will separate the wheat from the chaff, but if the result is somebody thinking outside the box and another tech company not getting to milk their patent cows, it's not a bad thing.
